2. PURPOSE AND SCOPE

These General Terms and Conditions of Sale govern distance sales of products concluded on the website differentofficiel.com between DIFFÉRENT and its consumer customers.

They set out, in particular, the conditions of ordering, payment, delivery and returns, and the applicable warranties.

The customer is invited to read these General Terms and Conditions of Sale (CGV) before placing an order.

Confirmation of the order entails acceptance of these CGV under the conditions presented during the ordering process.

3. PRODUCTS

DIFFÉRENT sells, in particular, fashion clothing and accessories.

The essential characteristics of the products are presented on the corresponding product pages.

We endeavour to present the products as accurately as possible. Slight differences in colour or rendering may result, in particular, from the settings of the screen used.

Product offers are valid while stocks last.

If a product becomes unavailable after the order, the customer will be informed as soon as possible and will benefit from the remedies provided for by the applicable regulations.

4. PRICES

Prices are stated in euros (€), inclusive of all taxes (TTC), unless otherwise indicated.

DIFFÉRENT may change its prices at any time. The price invoiced is the price displayed and applicable at the time the order is confirmed, subject to the correction of any manifest error.

Any delivery costs are indicated to the customer before the final confirmation of their order.

5. ORDERS

The customer selects the products they wish to purchase and follows the various steps of the ordering process.

Before finally confirming their order, the customer may check its contents and correct any errors.

The customer undertakes to provide the accurate, complete and up-to-date information necessary for the processing of their order.

After confirmation, an order confirmation is sent to the customer electronically.

DIFFÉRENT may refuse or suspend an order for a legitimate reason, in particular in the event of fraud, reasonable suspicion of fraud, a payment incident or a prior dispute relating to the payment of an order.

6. PAYMENT

Payment is due at the time of the order.

The means of payment offered may include, in particular:

  • bank card;
  • Apple Pay;
  • PayPal;

depending on the means actually available at the time of the order.

Transactions are processed by the payment service providers offered by or integrated into our Shopify store.

DIFFÉRENT does not necessarily retain all of the bank details used to make the payment.

7. DELIVERY

The available delivery areas, methods, rates and times are indicated during the ordering process and/or in our Shipping Policy.

The customer must provide a complete and accurate delivery address.

DIFFÉRENT remains subject to the applicable legal obligations regarding delivery.

The risk of loss of or damage to the goods passes to the consumer under the conditions provided for by the applicable legislation.

8. STATUTORY RIGHT OF WITHDRAWAL

For distance contracts benefiting from the right of withdrawal (droit de rétractation), the consumer has a period of 14 days from receipt of the goods to inform DIFFÉRENT of their decision to withdraw, without having to give any reason for their decision.

The decision may be communicated by means of an unequivocal statement to:

contact@differentofficiel.com

or by post to:

DIFFÉRENT
39 rue Ramponeau
75020 Paris
France

The consumer may also use the model withdrawal form available in our Return and Refund Policy, although its use is not mandatory.

After communicating their decision to withdraw, the consumer must return the goods without undue delay and, at the latest, within 14 days of that communication.

The direct cost of returning the goods is borne by the consumer, except where DIFFÉRENT agrees to bear it or where the regulations provide otherwise.

9. EXCEPTIONS TO THE RIGHT OF WITHDRAWAL

The right of withdrawal cannot be exercised in the situations provided for by Article L.221-28 of the French Consumer Code (Code de la consommation).

For products likely to be sold by DIFFÉRENT, this may concern in particular:

  • goods made to the consumer’s specifications or clearly personalised;
  • sealed goods which have been unsealed after delivery and which cannot be returned for health protection or hygiene reasons.

The mere fact of trying on a garment does not automatically entail the loss of the statutory right of withdrawal.

The consumer may, however, be held liable for any diminished value of the goods resulting from handling other than what is necessary to establish their nature, characteristics and proper functioning, under the conditions provided for by the regulations.

10. COMMERCIAL RETURN POLICY — 30 DAYS

Independently of the statutory right of withdrawal, DIFFÉRENT offers a commercial return policy of 30 days from receipt of the order, subject to the conditions set out in our Return and Refund Policy.

Under this policy:

Refund: the direct cost of returning the goods is borne by the customer.

Size or colour exchange: return costs are covered by DIFFÉRENT, subject to availability.

Store credit: return costs are covered by DIFFÉRENT.

In-store return: returns are free of charge at our store located at 39 rue Ramponeau, 75020 Paris.

These commercial benefits do not affect the statutory rights enjoyed by the consumer.

11. REFUND IN THE EVENT OF WITHDRAWAL

When the statutory right of withdrawal is exercised, DIFFÉRENT refunds the sums due, including the initial standard delivery costs where required by law.

Any additional costs resulting from the choice of a delivery method more expensive than the standard method offered are not refunded, under the conditions provided for by the regulations.

The refund is made without undue delay and at the latest within 14 days from the date on which DIFFÉRENT is informed of the decision to withdraw.

For sales of goods, DIFFÉRENT may withhold the refund until the goods have been recovered or until proof of their dispatch has been received, whichever is the earlier.

The refund is made using the same means of payment as that used for the initial transaction, unless otherwise agreed under the conditions provided for by law.

12. LEGAL GUARANTEE OF CONFORMITY

The consumer benefits from the legal guarantee of conformity (garantie légale de conformité) provided for in Articles L.217-3 et seq. of the French Consumer Code.

The seller is liable for any lack of conformity existing at the time of delivery of the goods and becoming apparent within two years from delivery, under the conditions provided for by law.

In the event of a lack of conformity, the consumer is entitled to the remedies provided for by the French Consumer Code, in particular having the goods brought into conformity by repair or replacement under the legal conditions and, where the conditions are met, a price reduction or termination of the contract.

This legal guarantee is independent of any commercial guarantee.

13. WARRANTY AGAINST HIDDEN DEFECTS

The consumer also benefits from the warranty against hidden defects (vices cachés) provided for in Articles 1641 et seq. of the French Civil Code (Code civil).

Where the legal conditions are met, the consumer may exercise the remedies provided for by the French Civil Code.

14. LIABILITY

DIFFÉRENT is responsible for the proper performance of its obligations under the conditions provided for by the applicable regulations.

However, DIFFÉRENT cannot be held liable for damage resulting from misuse of the product by the customer or from an event constituting force majeure within the meaning of the applicable regulations.

No provision of these CGV may have the effect of excluding or limiting rights or liabilities that cannot lawfully be excluded or limited.

15. FORCE MAJEURE

The performance of obligations may be suspended upon the occurrence of an event meeting the legal conditions of force majeure.

The rights enjoyed by the consumer under mandatory provisions remain applicable.

16. PERSONAL DATA AND COOKIES

Personal data collected in connection with the order and the use of the website is processed in accordance with our Privacy Policy.

Information on cookies and other trackers and on the choices available to the user is also accessible on our website.

17. INTELLECTUAL PROPERTY

The texts, photographs, graphics, logos, creations, videos and other content on differentofficiel.com are protected by the applicable intellectual property rights.

Except with authorisation or where an exception is provided for by law, their reproduction, representation or exploitation without prior authorisation is prohibited.

18. CUSTOMER SERVICE

For any question, complaint or request concerning an order:

Email: contact@differentofficiel.com
Telephone: 01 87 42 36 76

DIFFÉRENT

19. CONSUMER MEDIATION

In accordance with the provisions of the French Consumer Code, the consumer has the right to have recourse, free of charge, to a consumer mediator (médiateur de la consommation) with a view to the amicable resolution of a dispute with DIFFÉRENT, after having first sent a written complaint to DIFFÉRENT and where the dispute could not be resolved directly.

Competent mediator: to be completed once DIFFÉRENT has joined a consumer mediation scheme listed by the CECMC (Commission d’évaluation et de contrôle de la médiation de la consommation).

The mediator’s contact details and website will be indicated here as soon as this membership has been finalised.

20. GOVERNING LAW AND DISPUTE RESOLUTION

These CGV are governed by French law.

This provision does not deprive a consumer residing in another State of the mandatory protective provisions they enjoy under the applicable regulations.

In the event of a dispute, the customer is invited to contact DIFFÉRENT first in order to seek an amicable solution.

Failing an amicable resolution or mediation, the consumer may bring the matter before the competent courts under the conditions provided for by the applicable legal rules.

21. CHANGES TO THE CGV

DIFFÉRENT may amend these CGV in order, in particular, to take into account changes in its business or in the regulations.

The CGV applicable to an order are those accepted by the customer when that order was concluded.
